Terms of Service

These Terms of Service (“Terms”) govern your use of Familiar, a family collaboration platform operated by Zine Digital (“Zine”, “we”, “us”, or “our”). By creating an account or using Familiar, you agree to these Terms. If you do not agree, you may not use the service.
1. Acceptance of Terms
By accessing or using Familiar you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction), have read and understood these Terms, and agree to be bound by them. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.
1.1 Geographic Restrictions
Familiar is not available to users in countries or regions subject to comprehensive international sanctions, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. We reserve the right to block access from any jurisdiction where we determine that our services may violate local laws or regulations. By using Familiar, you represent and warrant that you are not located in any prohibited jurisdiction and that your use of the service complies with all applicable local laws.
2. Description of Service
Familiar is a proprietary family management platform that provides tools including shared shopping lists, chores, notes, rewards, notifications, offline synchronisation, invitations, and user-authorised integrations. The service is provided on a subscription basis with a free tier and paid plans.
2.1 Geographic Availability
Familiar is primarily intended for users in Nigeria and other jurisdictions where our services comply with applicable laws. We do not guarantee that all features or payment methods are available in all countries. By using Familiar, you confirm that you are not located in a country subject to comprehensive sanctions or export restrictions, and that your use of the service complies with all applicable local laws.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete registration information.
- You may not share your account with others or create accounts on behalf of third parties without authorisation.
- You are responsible for all activity that occurs under your account.
- Family administrators are responsible for membership, invitations, roles, and access credentials they issue for their workspace.
4. Subscription Plans & Billing
Familiaroffers free and paid subscription tiers. Bachs processes checkout and recurring billing in its hosted overlay. Paid subscriptions are billed in advance and renew automatically at the interval shown at checkout until cancelled. Prices, currency, taxes, trial terms, and renewal dates are displayed before you confirm payment. Prices may change with 30 days' notice. You may request cancellation at any time; unless law or the checkout terms require otherwise, access continues through the paid period.
4.1 Refund Policy
We do not offer refunds for subscription fees except in cases of billing errors. If you are double-billed, over-billed, or charged incorrectly due to a technical error, you may request a refund by contacting us atlegal@zine.ng within 30 days of the incorrect charge. Refund requests will be reviewed and processed within 14 business days. All other subscription payments are non-refundable. This policy applies regardless of your payment method or location.
4.2 Billing Errors
In the event of a billing error, we will promptly investigate and rectify the issue. If we determine that an error occurred on our end or with our payment processor, we will issue a refund for the erroneous charge(s). We reserve the right to request supporting documentation to verify billing errors.
5. Connected Assistants and Automated Access
You may create revocable credentials that allow a third-party assistant or platform to read or update selected Familiar data. You choose the family and scopes. You are responsible for the third party you connect, its instructions, and actions it takes within those scopes. Keep credentials confidential, grant the minimum access needed, review audit activity, and revoke access promptly if a credential or connected service may be compromised. Automated output can be incomplete or incorrect; review material actions before relying on them. Familiar does not provide medical, legal, financial, nutritional, or safety advice.
6. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any regulations, including local, national, or international laws.
- Post or share content that is harmful, abusive, hateful, or infringes third-party rights.
- Attempt to reverse engineer, decompile, or extract the source code of the software.
- Use automated tools to scrape, crawl, or systematically access the service without our consent.
- Share integration credentials publicly, exceed granted scopes, bypass rate limits, or use an integration to access another household without authorisation.
- Interfere with or disrupt the integrity or performance of the service.
- Use the service to facilitate, enable, or encourage illegal activities, including but not limited to money laundering, fraud, or terrorism financing.
- Circumvent any technical measures we use to restrict access to the service, including geographic restrictions.
6.1 Content Restrictions
You are solely responsible for the content you create, store, or share through Familiar. You agree not to use the service to store or share content that is illegal, defamatory, obscene, or that violates the rights of others. We reserve the right to remove content that violates these provisions without prior notice.
7. Offline Use, Sync, and Notifications
Offline changes may remain on your device until connectivity returns. Sync timing, conflicts, device storage limits, browser data clearing, notification permissions, and third-party delivery systems may affect when an update appears. Do not rely on Familiar as the sole channel for urgent, emergency, medical, or safety-critical communication.
8. Intellectual Property
Familiar and all related software, designs, trademarks, and content are the proprietary property ofZine Digital. Your use of the service does not grant you any ownership rights. You retain ownership of content you create within the platform (e.g., notes, shopping lists); however, you grant us a limited licence to host, display, and transmit that content solely as necessary to provide the service.
9. Privacy
Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.
10. Disclaimer of Warranties
The service is provided “as is” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Zine Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or loss of profits, arising from your use of or inability to use the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
11.1 International Users
International users acknowledge that Zine Digital makes no warranties about the legality of Familiar in their specific jurisdiction. Zine Digital shall not be liable for any legal consequences arising from your use ofFamiliar in violation of local laws. You are solely responsible for ensuring your use complies with applicable local regulations, including but not limited to data protection, consumer protection, and financial services regulations.
11.2 Indemnification
You agree to indemnify, defend, and hold harmless Zine Digital, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of Familiar, your violation of these Terms, or your violation of any applicable laws or regulations. This indemnification obligation extends to claims related to your use of the service in jurisdictions where such use may be illegal or restricted.
12. Termination
We may suspend or terminate your account at any time for breach of these Terms or for any reason with 30 days' notice. Upon termination, your data may be deleted in accordance with our data retention policy. You may delete your account at any time from the account settings.
12.1 Account Suspension and Termination
We reserve the right to immediately suspend or terminate your account without notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if your use of the service poses a security risk. Upon termination, you will lose access to your account and all associated data. We are not obligated to provide a refund for any unused portion of your subscription if your account is terminated due to violation of these Terms.
12.2 Data Handling After Termination
Upon account termination or deletion, we will delete or anonymise your personal data in accordance with our Privacy Policy and applicable data protection laws. However, we may retain certain data as required by law, for legitimate business purposes, or to resolve disputes.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Nigeria. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Nigeria.
13.1 International Compliance
If you access Familiar from outside Nigeria, you do so at your own risk and are responsible for compliance with local laws. We make no representation that Familiar is appropriate or available for use in other locations. Accessing Familiar from territories where the service is illegal is prohibited.
13.2 Export Control
Familiar and related technology may be subject to export control laws and regulations, including the Export Administration Regulations (EAR) and sanctions programs administered by the U.S. Office of Foreign Assets Control (OFAC). You agree not to export, re-export, or transfer Familiar or any related technology in violation of any applicable export control laws or regulations.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email or a prominent notice in the application at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
